Maui County Publishes Maui County Short-Term Vacation Rental List

After 4 years of work in progress, the County of Maui has finally published its approved short-term vacation rental list. By definition, Maui County classifies anything less than 6 months as short-term, but short-term vacation rentals are generally thought of those that allow nightly rentals. The list is not supposed to include hotel and resort properties that lawfully provide short-term occupancy through their underlying zoning, but it certain instances it does, you will see this below.

“If a property is on the list, then short-term occupancy is allowed without a permit. If a property is not on the list and someone believes that short-term occupancy is allowed by grandfathering or other means, then please contact the Planning Department so that we can make a determination,” Planning Director Michele McLean said. “We hope that the list is exhaustive but acknowledge that there could be properties that may have grandfathered status and that should be added.”

I myself along with the other Government Affairs Committee members for the Realtors Association of Maui are working with the County of Maui to clean this up and make it a complete and clear list.

What is the County of Maui Minatoya Opinion?

The Mintatoya opinion was a legal opinion issued in 2001. In this particular case, it allows vacation rentals of condo units in apartment-zoned properties despite the fact that the law itself (Maui County Code 19.12.010-C) clearly says that apartment-zoned buildings can only be used for long-term (180 days or longer) residential use. The “Minatoya” list covers condominiums, apartments and planned developments that are not hotels but that can lawfully conduct short-term or vacation rentals without any type of state or county permit.

There are two different phases of the Palms at Wailea — Palms at Wailea Phase I Condos for Sale does allow short-term vacation rentals whereas Palms at Wailea Phase II Condos for Sale does not. 

Kanai A Nalu Condos for Sale located in central Maui, more specifically Ma’alaea are permitted for short-term rentals, be sure to check out Kanai A Nalu 203 vacation rental website.

Papakea Condos for Sale are one of the most popular vacation rental destinations and does have the full feeling of a larger scale resort despite not being zoned as a Resort. Nevertheless, short-term vacation rentals are permitted. The Papakea resort is located right on the border of North Kaanapali and the start of Honokowai.

Maui Kaanapali Villas Condos for Sale also known as Hale Kaanapali (the name that appears on the list) are located directly on my favorite stretch of golden sand on Ka’anapali North Beach.

Kaanapali Alii Condos for Sale are one of the hotel zone properties that you still find on this list, which is a contradiction to the intention of the list. As I stated at the beginning of this post, we are working to resolve this.

Aina Nalu Condos for Sale are located right in the heart of Lahaina town, they are very popular for investors, those with second homes, and guests alike.

Hi,
We have been considering purchsing a condo in Maui. We would want to be able to rent it out as a short term vacation rental. We have stayed at the International Colony Club which has just been added to this list, are those good for vacation rentals?

Mahalo for taking the time to comment on my post. Yes! International Colony Club units are on this list and do rent extremely well. I used to live right above the Colony Club and we love Airport Beach right across the street from it. I will send you an email about it right now.

I don’t see any mention of Pohailani, but I see many of the duplexes listed for rent online. Can you confirm if the duplexes here are allowed to do short-term rentals? Are they grandfathered?
