Recently, there has been a movement / legislation on Maui to stop short-term rentals that are not hotel zoned. Many short-term rental condos fall under apartment zoning and have been able to legally operate due to a ruling in 2001 placing them on the Minatoya List, essentially grandfathering these properties to continue as short-term rentals. However, the recent uncertainty and the potential for pending litigation is a cause for the increase in condos on the Minatoya list coming up for sale around the island.
